How is Reckless Driving Different Than Other Traffic Violations?
Hampton Roads, Virginia is home to numerous major interstates, hosts thousands of tourists flocking to the beach and boasts the largest Naval Base in the country. Considering this, it is no surprise that hundreds of citizens receive Reckless Driving tickets in Hampton Roads each year – and most are shocked to learn that they didn’t just receive a simple ticket, but instead, they have been charged with a criminal offense!
What is reckless driving?
In Virginia, reckless driving is a Class 1 Misdemeanor criminal offense. It is often punished by fines, imprisonment, and/or driver’s license suspension or revocation. Furthermore, the Virginia DMV considers Reckless Driving a 6 point moving violation which stays on the driving record for 11 years. North Carolina drivers who receive a Reckless Driving ticket based on speed will have their driver’s license administratively suspended for 30 days.
Violations that are considered reckless driving:
- Speeding in excess of 20 mph over the speed limit.
- Moving violations such as passing a school or emergency vehicle.
- Driving too fast for weather conditions.
- Speeding in excess of 80 mph.
- Failure to maintain control of your vehicle
Punishment for reckless driving:
In Virginia, punishment for Reckless Driving includes a permanent criminal conviction on your record. The maximum punishment for Reckless Driving is 12 months in jail, $2500 fine and 6 months suspension of the defendant’s driving privilege. There may also be additional financial repercussions, including increased insurance premiums and civil lawsuits.
I’ve received a Reckless Driving Ticket – what now?
Simply because an officer charges you with Reckless Driving, it doesn’t mean you will be convicted of Reckless Driving.
