The Commonwealth of Virginia allows adoptions through agency or non-agency placements. Agency placement involves the local department of social services or a private licensed child placing agency. In an agency placement, the child’s parents have relinquished or lost their legal rights completely, so the child is either in the custody of the Commonwealth or the agency. All that is required is the Commonwealth and the agency’s approval of your adoption petition.

On the other hand, in non-agency adoptions, the child’s parents or legal guardians still enjoy all their parental rights and you must petition the court to legally terminate them or to obtain the consent of the parents.
